These Terms of Service (“Terms”) govern your access to and use of the school spirit fundraiser store websites (the “Site”) operated by LCreate Media (“we,” “us,” or “our”). By visiting the Site, placing an order, or using any part of the Site, you agree to these Terms.

If you do not agree, please do not use the Site.

1) Fundraiser Stores and Benefiting Organizations

The Site is a school spirit fundraiser store. Purchases made through the Site may support a specific school organization (such as a PTO, booster club, team, band, class, or similar group) (the “Benefiting Organization”).

LCreate Media provides the platform and store operations, and may provide production and fulfillment services depending on the fundraiser. The Benefiting Organization may receive fundraising proceeds and reports as described on the Site.

2) Eligibility and Account Responsibility

You must be at least 18 years old (or the age of majority in your state) to place an order without a parent/guardian. If you create an account or provide contact information, you agree that the information you provide is accurate and that you are responsible for maintaining the confidentiality of your login details (if applicable).

3) Products, Designs, and Availability

A. Product Display and Colors

We make reasonable efforts to display product colors, sizing, and images accurately. However, colors may vary due to screen settings, lighting, and device differences. Product mockups are for preview purposes.

B. Product Availability

Products may be offered for limited times during fundraiser windows. Items may become unavailable without notice.

C. Custom and Made-to-Order Items

Many fundraiser items are made-to-order or customized. As a result, certain orders may have limited cancellation or return options (see Section 7).

4) Pricing, Taxes, and Fundraiser Proceeds

A. Pricing

Prices are shown on the Site and may change at any time. The price you pay is the price displayed at checkout.

B. Taxes

Sales tax may be collected where required by law and will be calculated at checkout when applicable.

C. Fundraiser Proceeds

A portion of each purchase may support the Benefiting Organization. Fundraiser proceeds are calculated based on the fundraiser agreement and may be distributed after the fundraiser closes and orders are processed.

5) Ordering, Payment, and Order Confirmation

A. Payment

We accept the payment methods shown at checkout through third-party payment processors (for example, Stripe or other providers). By submitting payment, you represent that you are authorized to use the payment method.

B. Order Confirmation

After you place an order, you will receive an order confirmation email or message. If you do not receive confirmation, contact us at [email protected].

C. Order Review

You are responsible for reviewing your order details (sizes, quantities, shipping address, and any customization notes) before submitting your order.

6) Fulfillment, Shipping, and Delivery

A. Production Times

Fundraiser items may require production time before shipment. Production timelines may vary by product, order volume, and fundraiser schedule. Estimated processing/shipping timelines may be shown on the Site.

B. Shipping

Shipping delivery times are estimates and not guarantees. Carrier delays, weather, and other factors may impact delivery.

C. School Delivery (If Offered)

If school delivery is offered on a fundraiser site, delivery timing depends on the school’s distribution process and may occur after the fundraiser closes. LCreate Media is not responsible for delays caused by school distribution schedules.

7) Returns, Exchanges, and Cancellations

Because many fundraiser items are made-to-order, return and cancellation policies are limited.

A. All Sales Final on Custom/Made-to-Order (Standard Fundraiser Policy)

Unless otherwise stated on the Site, all made-to-order and customized items are final sale.

B. Wrong, Defective, or Damaged Items

If you receive an item that is defective, damaged, or incorrect due to our error, please contact us within 7 days of delivery at [email protected] with:

Photos of the issue

A brief description of the problem

If confirmed, we will, at our discretion:

Replace the item, or

Issue a refund/credit

C. Size Issues

We strongly recommend reviewing the size chart before ordering. If an item does not fit due to ordering the wrong size, it may not be eligible for return or exchange unless otherwise stated on the Site.

D. Cancellations

Orders may only be canceled if production has not started. Fundraiser stores often move quickly into production; therefore, cancellations are not guaranteed. Contact us as soon as possible if you need to request a cancellation.

8) Intellectual Property and Permitted Use

A. Site Content

All Site content—including text, graphics, logos, images, and layouts—is owned by or licensed to LCreate Media and is protected by intellectual property laws.

B. School Names and Mascots

School-related names, mascots, and designs may be used with permission or under applicable agreements for the fundraiser. You may not reproduce, resell, or redistribute designs from the Site without written permission.

C. Restrictions

You agree not to:

Copy, reproduce, distribute, or exploit Site content without permission

Use the Site for unlawful or fraudulent purposes

Attempt to interfere with Site security or functionality

9) User Submissions (If You Upload or Submit Content)

If a fundraiser site allows you to submit content (such as names for personalization or delivery details), you represent that you have the right to provide that information. You grant us permission to use submitted information for order fulfillment and customer service purposes.

10) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use personal information.

11) Disclaimers

The Site and all products and services are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee uninterrupted access to the Site or that the Site will be error-free.

12) Limitation of Liability

To the fullest extent permitted by law, LCreate Media will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.

In no event will LCreate Media’s total liability exceed the amount you paid for the order giving rise to the claim.

Some states do not allow certain limitations, so some of the above may not apply to you.

13) Indemnification

You agree to indemnify and hold harmless LCreate Media from any claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or violation of any law or third-party right.

14) Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15) Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law rules.
